The purpose of this policy is to provide you with information on how NextMariner ApS ("NextMariner", "us", "we") processes personal data as data controller.
This privacy policy has been prepared in accordance with GDPR art. 13 and 14 and contains statutory information on how we, in our capacity as data controller, process personal data about our platform users, business partners, suppliers, applicants, website visitors, followers on social media, and others who contact us or about whom we otherwise receive or obtain personal data.

The scope of our processing of your personal data will vary depending on your relationship with us. Below you can read more about how we process personal data about you depending on your relationship with us.
We process your personal data if you are a platform user, including if you are a contact person at a company that has made a user on NextMariner. We collect your data either from you or the company you are employed by. In these cases, we may process the following personal data about you:
In cases where you provide us with additional information about yourself, we will also process such personal data to the extent necessary for the purpose.
If you are a platform user, including a contact person at a company that is using NextMariner, we process your personal data in order to fulfill our contractual obligations under the relationship with you or the company you are employed by. The purpose of processing your personal data is therefore to be able to deliver the necessary service on the platform or to enable you to fulfil your duties as an employee. The legal processing basis for this data is found in GDPR art. 6(1)(b) or GDPR art. 6(1)(f).
In certain cases, we may disclose your data to other platform users or business partners. The disclosure is made solely for the purpose of fulfilling our contractual obligations with you. We only disclose your personal data if we have a valid processing basis for doing so, as stated above.
The platform lets one user keep private notes, tags and a rating about another user they have met, for example after scanning a badge at a trade fair. NextMariner is the controller of those records. They are not shown to the person they describe, are never combined into any score or average about them, and are erased when either account is closed. As with all personal data we hold about you, you may ask for a copy of them under your right of access described in section 7.
We process your personal data if you are one of our business partners, suppliers or if you are a contact person at one of our business partners or suppliers. We collect your data either directly from you or from the company you work for. In these cases, we may process the following personal data about you:
In cases where you provide us with additional information about yourself, we will also process such personal data to the extent necessary for the purpose.
We process your personal data for the purpose of entering into or fulfilling an agreement with you or the company with which you are a contact person, or to enable you to fulfil your duties as an employee. The legal processing basis for this data is found in GDPR art. 6(1)(b) and in respect of certificates consent cf. GDPR art. 6(1)(a).
In certain cases, we may disclose your data to other business partners and suppliers or to our customers. The disclosure is made solely for the purpose of fulfilling our contractual obligations with you. We only disclose your personal data if we have a valid processing basis for doing so, as stated above. Certificates can be shared with other users/business partners if you have provided your consent for this data sharing.
We process your personal data if you apply for a job with us. We generally collect all information from you but may in some cases collect information from recruitment agencies or references provided by you. In these cases, we may process the following personal data about you:
In cases where you provide us with additional information about yourself, we will also process such personal data to the extent necessary for the purpose.
The purpose of processing your personal data is to assess whether you may be a suitable candidate and to invite you for an interview with a view to potentially offer you employment with us. Our legal basis for processing your personal data for these purposes is GDPR art. 6(1)(f), as we have a legitimate interest in being able to assess your suitability for a specific or future position at NextMariner based on the information we have received.
If you are not hired by NextMariner, we may store your application to document the recruitment process, but we will generally delete your application no later than 6 months after the start of the process. If we wish to store your job application and attachments for any subsequent relevant positions, we will obtain your consent for continued storage for a limited period, cf. GDPR art. 6(1)(a).
We process your personal data if you contact us either by email, phone or our contact form on our website. We only process personal data about you that we receive directly from you in connection with your inquiry. In this case, we may process the following personal data about you:
In cases where you provide us with additional information about yourself, we will also process such personal data to the extent necessary for the purpose.
We process your personal data in order to respond to your inquiry. Our processing basis for this is GDPR art. 6(1)(f). We have therefore balanced our interest in responding to your inquiry against your interest in not having your personal data processed by us.
We process your personal data if you receive our newsletter and/or our marketing materials. We only process personal data from you that you have given us yourself. In this case, we may process the following personal data about you:

We process your personal data for the purpose of sending newsletters and/or marketing materials. Our processing basis for this is GDPR art. 6(1)(a). This means that we only process your personal data for marketing purposes if you have given your consent.

We process your personal data when you visit and interact with us via our website or social media. We only process personal data that is automatically collected in connection with your visit to our website and personal data you share with us via social media. In these cases, we may process the following personal data about you:

We process your data in order to ensure user-friendliness and security and to optimize and operate our website and platform. We also process your personal data in order to be able to interact with you via our social media, including getting in touch with you and promoting our marketing.
Our legal basis for processing your personal data is GDPR art. 6(1)(a) and (f). If you have given your consent to the processing of your personal data, for example via cookies, you will be able to withdraw this consent at any time. In cases where we process your personal data on the basis of our legitimate interest, we have balanced our interest in being able to interact with you via social media against your interest in not having your personal data processed.
When we process your personal data via social media, we have a so-called joint data responsibility with the social media we use, as both NextMariner and the social media in question process your personal data for their own purposes. In addition to the specific disclosures described above, we generally do not disclose your information to third parties unless we have obtained consent or are required to do so under applicable law, including to public authorities.
In certain cases, we may transfer your personal data to our system suppliers who process your personal data on our behalf and according to our specific instructions. In such cases, we have entered into a data processing agreement with the system suppliers as data processors to ensure that your personal data is processed in a lawful manner.
In some cases, we may use data processors outside the EU/EEA, which means that personal data may be transferred to third countries. Such a transfer takes place on the basis of a data processing agreement and a valid transfer basis and adequate security measures.
We retain your personal data for as long as necessary for the purpose. This is determined based on a concrete assessment of the importance of the data for the fulfillment of our obligations and for the purpose. As a general rule, we store personal data for the duration of the platform user, business or supplier relationship and for five years thereafter in accordance with our statutory obligation under the Danish Bookkeeping Act.
In cases where the processing of your personal data is based on consent, we store your personal data until we no longer have a purpose for it or until the consent is withdrawn. We apply special deletion rules for processing job applications, see section 3.3 above.
In some cases, we will also store personal data that is necessary to protect our legitimate interests, including in the event of disputes and/or protection of NextMariner's legal rights. In such cases, NextMariner has balanced our interests in protecting our legal rights against your interests in the deletion of your personal data in accordance with GDPR art. 6(1)(f).
In accordance with the data protection principles of lawful and transparent processing, we strive for data minimization and storage limitation and maintain the integrity and accountability necessary for the fairness of the processing.
NextMariner have appropriate technical and organizational measures in place to protect against unauthorized access to, loss or destruction of the personal data and other data under our control.
We continuously develop our security policies and procedures to ensure that our systems are secure and protective. Only persons who have a purpose to process your personal data for the mentioned purposes have access to the personal data.
Under the GDPR, you have several rights when your personal data is processed by us, including:
Right of access
You have the right to access the personal data we process about you and further information about the processing.
Right to rectification
You have the right to have incorrect data corrected.
Right to erasure
In special cases, you have the right to have data erased before our general erasure takes place.
Right to restriction of processing
In some cases, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, the processing - except for storage - may only take place in the future if consent has been given or for the establishment, exercise or defense of legal claims or to protect a person or important public interests.
Right to object
In specific cases, you have the right to object to our processing of your personal data or our legal basis for processing your personal data. You also have the right to object to our processing of your personal data for direct marketing purposes.
Right to data portability
You have the right to receive the registered personal data in a structured, commonly used and machine-readable format and have the data transferred from one controller to another without hindrance.
Right to withdraw your consent
When your consent is the legal basis used to process your personal data, you have the right to withdraw your consent at any time. If you choose to withdraw your consent, it will not affect the lawfulness of our processing based on your consent up to the time of withdrawal.
In connection with the exercise of the above rights, we may require relevant identification.

Complaints (EU/EEA)
You can file a complaint with the Danish Data Protection Authority if you are dissatisfied with our processing of your personal data. You can find contact details for the Danish Data Protection Authority at www.datatilsynet.dk.
NextMariner has its headquarters in Denmark and the Danish Data Protection Agency, as the leading supervisory authority, is therefore competent to handle complaints based on personal data processing by NextMariner.
